What is Negligence?

• Negligence is a tort that occurs when a person fails to exercise reasonable care, resulting in harm or injury to another person

• Differs from intentional torts (battery, assault) as it does not involve intent to cause harm
• Plaintiff must establish four key elements: duty, breach, causation, and damages
• Applies in various contexts such as car accidents, slip and fall cases, and medical malpractice
• Focuses on the defendant's conduct rather than their state of mind

Elements of Negligence

• Duty: The defendant owed a legal duty of care to the plaintiff
  • Duty arises from the relationship between the parties or the defendant's actions
  • Requires the defendant to act as a reasonable person would in similar circumstances
• Breach: The defendant breached their duty by failing to act with reasonable care
  • Determined by comparing the defendant's conduct to that of a reasonable person
  • Considers factors such as the foreseeable risk of harm and the cost of preventing it
• Causation: The defendant's breach of duty caused the plaintiff's injuries
  • Requires both cause-in-fact (but-for causation) and proximate cause (legal causation)
  • Cause-in-fact: The harm would not have occurred but for the defendant's negligence
  • Proximate cause: The harm was a reasonably foreseeable consequence of the defendant's actions
• Damages: The plaintiff suffered actual harm or losses as a result of the defendant's negligence
  • Can include physical injuries, property damage, and economic losses
  • Plaintiff must prove the extent and value of their damages

Duty of Care Explained

• Duty of care is a legal obligation to act with reasonable care to avoid causing foreseeable harm to others
• Arises from the relationship between the parties or the defendant's actions
• Requires the defendant to anticipate and take steps to prevent risks of harm
• Varies depending on the circumstances and the nature of the relationship
• Determined by considering factors such as the foreseeability of harm, the likelihood of injury, and the burden of preventing it
• Failure to fulfill the duty of care can result in liability for negligence
• Duty of care is the first element that must be established in a negligence claim

Establishing Duty of Care

• Duty of care can be established through common law principles or statutory duties
• Common law duties arise from the relationship between the parties or the defendant's actions
  • Examples include the duty of a driver to operate their vehicle safely or a property owner's duty to maintain safe premises
• Statutory duties are imposed by specific laws or regulations
  • Examples include building codes, workplace safety regulations, and product safety standards
• Foreseeability of harm is a key factor in determining the existence and scope of a duty
  • Defendant must be able to reasonably anticipate the risk of harm to the plaintiff
• Relationship between the parties can give rise to special duties
  • Examples include the duty of a doctor to their patient or a teacher to their students
• Voluntary assumption of a duty can also create a legal obligation
  • Example: A person who voluntarily undertakes to rescue someone in distress assumes a duty to exercise reasonable care in doing so

Neighbor Principle

• The neighbor principle is a concept used to determine the existence and scope of a duty of care
• Originated from the case of Donoghue v Stevenson (1932) in the United Kingdom
• States that a person owes a duty of care to their "neighbor" who may be reasonably foreseeably affected by their actions
• "Neighbor" is not limited to physical proximity but includes anyone who is closely and directly affected by the defendant's conduct
• Requires the defendant to take reasonable care to avoid acts or omissions that could reasonably be foreseen to cause injury to their neighbor
• Extends the duty of care beyond contractual relationships to include third parties
• Helps establish the legal basis for negligence claims in various contexts

Special Relationships and Duty

• Certain relationships give rise to a heightened or special duty of care due to the nature of the relationship and the level of trust or dependence involved
• Examples of special relationships include:
  • Doctor-patient: Doctors owe a duty to provide competent medical care and advice to their patients
  • Teacher-student: Teachers have a duty to supervise and protect students under their care
  • Employer-employee: Employers must provide a safe working environment and proper training
  • Common carriers-passengers: Common carriers (buses, trains) owe a high duty of care to ensure the safety of their passengers
• Special relationships often involve an imbalance of knowledge, skill, or control between the parties
• The party with greater knowledge or control assumes a higher duty to protect the other party from foreseeable harm
• Breach of a special duty can result in liability for negligence even if the level of care would be sufficient in an ordinary relationship

Duty in Specific Situations

• Duty of care can vary depending on the specific situation or context
• Premises liability: Property owners owe a duty to maintain safe conditions for visitors, with the level of duty varying based on the visitor's status (invitee, licensee, trespasser)
• Professional negligence: Professionals (doctors, lawyers, accountants) owe a duty to exercise the skill and care expected of a reasonable professional in their field
• Product liability: Manufacturers and sellers owe a duty to ensure their products are safe and free from defects that could cause foreseeable harm
• Negligent infliction of emotional distress: A duty may arise to avoid causing severe emotional distress to others in certain circumstances
• Rescue doctrine: A person who voluntarily undertakes a rescue owes a duty to exercise reasonable care in doing so, but is not obligated to put themselves in danger
• Duty to control others: In limited circumstances, a person may have a duty to control the actions of others to prevent foreseeable harm (e.g., parents' duty to control their children)

Limitations and Exceptions

• Not every injury or harm gives rise to a negligence claim, as there are limitations and exceptions to the duty of care
• No duty to rescue: In general, there is no affirmative duty to rescue others from harm, unless a special relationship exists or the defendant created the risk
• Assumption of risk: A plaintiff who voluntarily assumes a known risk may be barred from recovering damages for negligence
  • Example: A spectator at a baseball game assumes the risk of being hit by a foul ball
• Contributory negligence: In some jurisdictions, a plaintiff's own negligence can bar recovery if it contributed to their injuries
• Comparative negligence: Other jurisdictions apportion fault between the plaintiff and defendant, reducing the plaintiff's recovery based on their percentage of fault
• Immunity: Some defendants, such as government entities or emergency responders, may be immune from negligence claims in certain circumstances
• Statute of limitations: Negligence claims must be brought within a specified time period after the injury occurs, or the claim may be barred
